John Spencer, chairman of the Motor Accident Solicitors Society (MASS), has responded to a press release issued by the ABI earlier this week, entitled “Dysfunctional and Disproportionate: ABI reveals how motorists are being taken for a ride by high legal costs”.

Spencer expressed his incredulity at the ABI’s complaint, without reservation, regarding the high legal costs solicitors receive.

He went on to say that representatives from the insurance sector participated in discussion with the Ministry of Justice regarding the development of fixed fees pertaining to streamlined road traffic accident (RTA) claims.

These claims represent approximately three-quarters of those that occur (674,977 claims out of 861,325), and Spencer has expressed his disbelief that insurers are complaining about fees that they themselves agreed to.

Spencer pointed out that the fees had not increased, even on an inflationary basis, since they were agreed in 2003, and challenged the ABI to share their detailed evidence and calculations related to the high costs involved.
