Hiscox welcomes HWM judgement

Technology company HWM has been backed by the Irish courts in their defence against claims of copyright infringement and breach of confidence.

Specialist insurer Hiscox has praised the judgement, which has been seen to support the right of IT employees in Ireland to claim their knowledge and experience as intellectual property.

Hiscox’s International Technology Claims Manager Ian Birdsey has expressed the firm’s pleasure at having backed a ground-breaking legal case which will probably set a precedent in Ireland.

HWM was subject to a legal challenge by a competitor which had argued that ex-employees had engaged in copyright infringement and breach of confidence.

Birdsey went on to say that it was vital that start-up firms in the technology sector were able to launch independently developed products using the expertise employees had acquired during the course of their careers.

HWM MD Shamus O’Donnell has heartily welcomed the result, and stated that anything else would have led to a severe restraint of trade which would have damaged the vitality and entrepreneurship of Ireland’s technology sector.

O’Donnell expressed his thanks to Hiscox, adding that the insurer had more than gone the extra mile for HWM and had backed them from the start.
