High Court finds Total liable for Buncefield oil fire claims
A High Court ruling has established liability for the Buncefield oil fire, which occurred in Hemel Hempstead in December of 2005, when a vapour cloud emanating from a major petrol spillage ignited.
The explosion was reported to be the largest ever in peacetime Europe.
Forty-three people were injured and claims, including damage to property, amounted to over £750 million.
Legal wrangling over liability has taken three years to resolve because operations at the Buncefield site involved a joint venture company established between Total and Chevron.
However, Mr Justice David Steel has ruled that oil firm, Total, is responsible for all individual and business losses relating to the event.
Allianz has welcomed the judgement, having already settled claims in relation to the explosion although the insurer’s property claims manager, Harry Rule, complains that the in-fighting between Total and Chevron caused delays for claimants and unnecessary legal expense.
Law firm, Kennedys, acted for insurers and others involved in the case.
