Insurers face longer claims period after Lords’ ruling
The House of Lords made a judgement today which effectively increases the time period during which a victim of abuse can seek financial compensation from their attacker.
The abuser’s employer may also be affected by the ruling, in areas such as education or social care.
Prior to the judgement a victim had to bring a sexual assault claim within six years of their 18th birthday for the claim to be considered by a court.
The ruling gives courts discretion to lengthen the eligible time period for claims to be made for both negligence and sexual assault.
However, cases will each be judged on an individual basis, and it is not guaranteed that a claim later than is usual will be heard by the courts.
Claims made against individuals who have not been convicted will essential be decided by whether the judge believes the claimant or the alleged attacker.
Because the time period has become much more open ended, it is possible that floodgates might be opened as a number of older cases are brought out into the open.
